I strive to ensure that shopping in my online store Neck Around is convenient, smooth, and secure, which is why I have created these terms and conditions. They explain the rights and obligations of the parties, as well as the principles of the sale, purchase, payment, delivery, and return of goods.

RIGHT TO PURCHASE

The goods sold in the online store are intended for adult website users who have reached the age of majority, as well as for legal entities (hereinafter referred to as the Buyer). By registering or placing an order on the website, the Buyer unconditionally confirms that they have the right to purchase from the online store and are legally capable of entering into binding contracts.

To shop in the online store, the Buyer must provide their personal data. The Buyer must provide their real first name, last name, telephone number, email address, and other requested information. In addition, the Buyer must provide valid and correct payment details and confirm that they are the person identified in the payment information.

ACCURACY OF PRODUCT CONTENT

All goods, prices, features, specifications, promotions, discounts, offers, photographs, and other information presented on the online store website may be changed at any time. The website reserves the right to make any changes without prior notice to the buyer.

Occasionally, the online store website or related services may contain information that includes typographical errors, inaccuracies, or omissions related to product descriptions, pricing, promotions, offers, shipping charges, delivery times, and availability. The website reserves the right to correct any errors, inaccuracies, or omissions, as well as to change or update information or cancel orders if any information on the online store website is inaccurate at any time without prior notice (including after an order has been placed).

The website is not obligated to update, correct, or clarify information on the online store or related services, including but not limited to pricing information, except as required by law. No specific update date on the online store website should be taken as an indication that the information has been changed or updated.

The colors of the goods displayed in the online store may differ from the actual colors. Because computer monitors vary, the company cannot guarantee that the buyer's computer will accurately display the colors.

Goods are available while stocks last. The website reserves the right to limit the order quantity of any product and/or refuse to provide service to any buyer without prior notice.

POSSIBLE DIFFICULTIES WITH THE SUPPLY OF GOODS

If difficulties arise with the supply of goods, the goods are no longer in stock, or for any reason the website is unable to fulfill an order, the buyer will be notified as soon as possible. If the website has already received payment for such an order, the amount received will be refunded to the buyer.

The website reserves the right to discontinue the supply of any product at any time. The website does not guarantee that any goods, services, information, or other materials purchased by the buyer will meet their expectations.

PLACING, CONFIRMING, AND ACCEPTING AN ORDER

To place an order, the buyer must follow the instructions of the online purchasing procedure. The buyer agrees to provide valid, complete, and accurate purchase and account information required for all purchases made in the online store. The buyer undertakes to promptly update their account and other information, including email address, credit card number, and expiration date, so that the company can successfully complete the transaction and contact the buyer if necessary.

The buyer is legally bound by their order from the moment they accept the company's online offer and all specified conditions are met (when the order is placed and payment is confirmed in the online store).

After placing an order, the buyer will immediately receive an order confirmation at the email address provided. This confirmation does not mean that the order has been accepted. An order is considered accepted only when the website informs the buyer by sending an email confirming that the goods have been shipped. Once the order has been shipped, the buyer will receive an email with a tracking number so they can monitor the status of the shipment.

PAYMENT

The online store accepts payments by credit or debit card and via e-banking. Payments can be made in euros. By submitting a payment, the buyer confirms that they are the holder of the payment card and that the payment details provided are correct and valid. Payment cardholders are subject to validation and authorization by the card issuer. If the buyer's payment card issuer refuses or does not authorize the payment, the company is not responsible for the rejection or delay of the purchase.

Credit and debit card payments are processed using the Stripe payment platform.

E-banking payments can be made via Swedbank, SEB, Luminor, Citadele, Šiaulių bankas, Paysera, and other electronic banking services. Payments can be made in euros.

INTELLECTUAL PROPERTY

The website is the owner of the online store and its content, including but not limited to images, texts, music, design, and software. The content of the website and the trademarks belonging to NeckAround are protected by intellectual property rights. Any use of the NeckAround trademark, the website, and its content, including the reproduction, copying, or storage of all or part of the content for commercial purposes without the express written permission of NeckAround, is strictly prohibited.

LIABILITY

NeckAround guarantees that the goods purchased in the online store will be of satisfactory quality and reasonably fit for the purpose for which such goods are usually provided. NeckAround's liability for any product purchased in the online store is strictly limited to the purchase price of that product. NeckAround assumes no liability for indirect losses, regardless of the cause of their occurrence.

The accuracy of the information on the online store website is not guaranteed or warranted. NeckAround is not responsible for any reliance on any information on the website, nor is it liable to any person for any loss or damage, direct, indirect, or consequential, that may arise from the use of any information on the online store website.

NeckAround cannot guarantee that the colors of the goods displayed in the online store will match the actual colors. NeckAround cannot be held responsible for color differences, as this depends in part on the buyer's monitor and computer color settings.

The online store website may contain links to other third-party websites that are beyond the company's control. NeckAround cannot be held responsible for the content or privacy policies of such websites.

PRIVACY POLICY

NeckAround is committed to handling all personal information responsibly. The submission of the Buyer's personal information in the online store is subject to NeckAround's privacy policy. Please read the entire NeckAround privacy policy.

ENTIRE AGREEMENT

These terms and conditions constitute the entire agreement between the Buyer and NeckAround and supersede any prior written or oral agreements, understandings, or arrangements between the Buyer and NeckAround. Both the Buyer and NeckAround declare that, in entering into this contract, neither party relied on any representations, undertakings, or promises made by the other party or implied by anything said or written during the negotiations between the Buyer and NeckAround prior to entering into this contract.

WRITTEN COMMUNICATION

Applicable laws may require that certain information be provided in writing. By using the website, the buyer agrees that communication with NeckAround will take place primarily electronically. For the purposes of the contract, the buyer agrees to this electronic means of communication and acknowledges that all electronic communication provided by NeckAround satisfies all legal requirements for such communication to be in writing.

APPLICABLE LAW

These terms and conditions are governed by the laws of the Republic of Lithuania, and any disputes or claims related to these terms and conditions are subject to the exclusive jurisdiction of the courts of the Republic of Lithuania.
